Terms of Service

By accessing or using txtile.eth ("the App", "we", "our", or "us") at https://txtile.xyz, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms apply to all users, including those who access the App via browser, mobile application, or any other means.

txtile.eth is a decentralized, end-to-end encrypted messaging application that enables users to send messages and transfer cryptocurrency. The App is built on open protocols including XMTP (for messaging) and Base (for payments).

Key features include:

• →End-to-end encrypted direct messages and group chats
• →Cryptocurrency payments (USDC, USDT, ETH, SOL)
• →Wallet-based identity via ENS names and Ethereum addresses
• →Non-custodial embedded wallets via Privy

You must be at least 18 years old to use the App. By using the App, you represent and warrant that:

• →You are at least 18 years of age
• →You have the legal capacity to enter into a binding agreement
• →Your use of the App does not violate any applicable law or regulation
• →You are not located in, or a resident of, any jurisdiction where use of the App is prohibited

The App provides non-custodial wallet functionality. This means:

• →You are solely responsible for safeguarding your wallet credentials and private keys
• →We do not custody, control, or have access to your funds
• →Cryptocurrency transactions are irreversible — we cannot recover lost or mistakenly sent funds
• →You are responsible for ensuring you send payments to the correct address
• →Blockchain transactions may incur network fees (gas) beyond our control
• →Txtile does not charge an app fee for transfers; only network and wallet-provider fees may apply

[WARN] Cryptocurrency investments and transfers carry significant risk. Never send funds you cannot afford to lose. The App is not a financial advisor and nothing in the App constitutes financial advice.

All messages sent through the App are end-to-end encrypted using the XMTP protocol. We do not have routine access to message content. When you deliberately use the report or block tools, a short content preview may be sent to our moderation tooling so the report can be investigated.

txtile operates a zero-tolerance policy for objectionable content and abusive users, including harassment, threats, hate, phishing, scams, sexual exploitation, and other harmful behavior.

You agree not to use the App to:

• →Send spam, phishing messages, or unsolicited commercial communications
• →Harass, threaten, or abuse other users
• →Transmit malware, viruses, or malicious code
• →Engage in fraud, scams, or deceptive practices
• →Violate any applicable laws or regulations
• →Infringe on the intellectual property rights of others

The app provides user-level safety controls including local filtering, block, and report actions. Blocking removes the abusive user from the blocked user's feed instantly on that device and also notifies support. Reports are reviewed within 24 hours and may result in suspension of access to the txtile app interface.

Because messages are encrypted and decentralized, moderation enforcement is limited at the protocol layer. However, we reserve the right to suspend access to the App interface for users who violate these Terms.

txtile.eth is built on decentralized, open-source protocols (XMTP, Base, Ethereum). We do not control these underlying networks and are not responsible for:

• →Network outages, congestion, or failures on XMTP or Base
• →Smart contract bugs or vulnerabilities in third-party protocols
• →Changes to protocol rules or fees by network validators
• →Loss of funds due to blockchain forks or reorgs

The App integrates with third-party services including:

• →Privy — wallet creation and authentication (privy.io)
• →XMTP — decentralized messaging protocol (xmtp.org)
• →Base — Ethereum L2 network for payments (base.org)
• →ENS — Ethereum Name Service for address resolution (ens.domains)

Your use of these services is subject to their own terms and privacy policies. We are not responsible for the practices or content of third-party services.

The txtile.eth name, logo, and App interface are our intellectual property. The underlying protocols (XMTP, Base, ENS) are open-source and subject to their respective licenses.

You retain ownership of any content you send through the App. By using the App, you do not grant us any license to your messages or content — we cannot access them.

The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that:

• →The App will be uninterrupted, error-free, or secure
• →Defects will be corrected
• →The App is free of viruses or other harmful components
• →Any specific results will be obtained from use of the App

To the fullest extent permitted by law, txtile.eth and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• →Loss of cryptocurrency or digital assets
• →Loss of data or messages
• →Loss of profits or revenue
• →Unauthorized access to your wallet or account
• →Any damages arising from use or inability to use the App

Our total liability to you for any claim shall not exceed $100 USD.

You agree to indemnify and hold harmless txtile.eth and its operators from any claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising out of or relating to your use of the App, your violation of these Terms, or your violation of any third-party rights.

We reserve the right to modify these Terms at any time. We will indicate the date of the most recent update at the top of this page. Your continued use of the App after any changes constitutes your acceptance of the new Terms.

We reserve the right to suspend or terminate your access to the App interface at any time, for any reason, including violation of these Terms. Because the underlying XMTP protocol is decentralized, we cannot prevent you from accessing the protocol directly.

These Terms are governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration on an individual basis. You waive any right to participate in class action lawsuits.
